Delaware's small business market in brief

Delaware is small in size but small businesses carry more than half its private workforce. The SBA Office of Advocacy's 2025 Small Business Profile counts 111,346 small businesses in the state, 98.7% of all firms, employing 214,539 people. That is 50.6% of private-sector employees. Between March 2023 and March 2024, small businesses added a net 5,323 jobs, 76.1% of the state's net gain.

About 22,800 Delaware small businesses have employees. The largest employer groups for MCA purposes are construction, with about 2,400 small employers, retail and other services, each with about 2,300, and healthcare, with nearly 2,300. Accommodation and food services has 3,433 small firms, and more than half of them, 1,905, have payroll, which reflects the restaurant and lodging economy at the beaches and in Wilmington.

Small firms also reach beyond the state line. Of the 1,897 identified Delaware exporters in 2023, 87.4% were small businesses, shipping $878.0 million in goods. For a funder, the takeaway is that Delaware's merchant base is compact but diverse: a single campaign can reach urban service businesses, a military town, farm suppliers and a seasonal resort economy within a two-hour drive. That diversity is useful, but only if you segment by county and season, because a Rehoboth Beach restaurant and a Newark dental office need very different offers in the same month.

Why is a Delaware company not always a Delaware merchant?

Delaware is the legal home of a very large number of companies that do business somewhere else. The state's Division of Corporations reported in its 2024 annual report that 66.7% of Fortune 500 companies are incorporated in Delaware, and many small LLCs choose Delaware formation too. For an MCA buyer, that creates a practical trap: a merchant whose entity says "Delaware LLC" may run its restaurant in New Jersey, its trucking company in Pennsylvania or its online store in California.

That matters for three reasons:

  • Compliance: state commercial financing laws are generally tied to where the recipient business is located or managed, not where it was formed. A Delaware-formed company operating in California, New York or Connecticut may trigger those states' disclosure rules.
  • Underwriting: local seasonality and competition depend on where the customers are, not the registered agent's address.
  • Calling hours: your dialer needs the merchant's actual time zone.

LoanLeads.io geography filters work on the business location the merchant provides on the form. Confirm the operating address on your first call, and route the file through the right state's process. Three counties, three MCA markets

Delaware has only three counties, and each one produces a different kind of merchant.

New Castle County

Wilmington, Newark, Middletown and the suburbs along Interstate 95 hold most of the state's population and business base. Banking and card-services operations, healthcare systems, the University of Delaware and the Port of Wilmington support restaurants, medical and dental practices, contractors, auto shops and service businesses. Middletown's growth has kept homebuilders and trades busy.

Kent County

Dover is the state capital and home to Dover Air Force Base. State government, the base and a large agricultural area support retail, restaurants, auto repair and trades. Events at Dover's motorsports and casino complex add short bursts of hospitality demand.

Sussex County

Rehoboth Beach, Lewes, Dewey Beach, Bethany Beach and Fenwick Island run on summer visitors, and Delaware's lack of a state sales tax draws shoppers to outlet and retail corridors along Route 1. Inland Sussex is part of the Delmarva poultry region, with growers, feed suppliers, equipment repair shops and haulers serving processing plants. Retirement growth along the coast has also expanded healthcare and home-service businesses.

CountyBusiest periodWhen owners tend to seek capital
New CastleFairly even through the year, with a holiday retail liftExpansion, equipment, slow-paying commercial customers
KentEvent weekends and the growing seasonBefore planting, before major events, after equipment failures
SussexMemorial Day to Labor DayFebruary to April for pre-season costs; fall to bridge winter

What rules apply to MCA funders in Delaware?

As of 2026, we are not aware of a Delaware statute that requires commercial financing disclosures or registration specifically for merchant cash advance providers or brokers. That may change, as more states have adopted such laws, including Connecticut, New York, Virginia and Florida.

Delaware's proximity to states that do regulate sales-based financing makes location checks routine. Wilmington sits minutes from Pennsylvania and New Jersey, and Sussex County borders Maryland, so a single owner may run locations in more than one state.

Federal rules apply regardless. The TCPA requires prior express consent for autodialed or prerecorded calls and texts, and LoanLeads.io captures consent on every lead. Telephone solicitations should fall between 8 a.m. and 9 p.m. Eastern Time for Delaware merchants. In every pitch, describe a merchant cash advance as what it is, a purchase of a portion of future receivables, not a loan, and avoid promising approval or funding.

Because so many companies are formed in Delaware but operate elsewhere, confirm which state's rules apply to each recipient. This is general information, not legal advice; confirm requirements with counsel.

How should you buy Delaware MCA leads?

Treat Delaware as a focused, seasonal campaign. Volume is modest, so the right lead mix and timing matter more than tight filters.

  1. Location: filter on Delaware operating locations and verify the address on the call.
  2. Revenue floor: around $15,000 to $20,000 in monthly deposits, using a twelve-month average for beach businesses.
  3. Industries: restaurants and hospitality, construction, retail, healthcare, auto repair and agricultural services.
  4. Lead mix: real-time exclusive MCA leads for New Castle County year round, plus aged MCA leads to cover Kent and Sussex at a lower cost per record.
  5. Timing: reach Sussex County hospitality and retail owners from February to April, when they prepare for summer, and again in September if they need to bridge the winter.

On the first call, ask three Delaware-specific questions: where the business physically operates, whether revenue is seasonal, and whether the owner runs locations in neighboring states. A Wilmington restaurant group with a second location across the line in Pennsylvania or Maryland, or a beach business that closes for part of the winter, needs an offer built around its actual deposit pattern. Ask for at least six months of bank statements, and a full year for Sussex County businesses, so underwriting sees both the peak and the off-season.

Measure cost per funded deal rather than cost per lead, and scale the counties that produce.

FAQ

Questions buyers ask

How many small businesses are in Delaware?

The SBA Office of Advocacy's 2025 Small Business Profile counts 111,346 small businesses in Delaware, 98.7% of all firms. They employ 214,539 people, or 50.6% of private-sector employees. About 22,800 of those businesses have employees, which is the main audience for merchant cash advance campaigns.

Does Delaware regulate merchant cash advances?

As of 2026 we are not aware of a Delaware statute that requires disclosures or registration specifically for merchant cash advances. Federal rules such as the TCPA still apply. Because many Delaware-formed companies operate in other states, check whether another state's disclosure law applies to the recipient, and confirm with counsel.

Is every Delaware LLC a Delaware merchant?

No. Delaware is a popular state of formation, and many companies incorporated there operate elsewhere. For underwriting, compliance and calling hours, what matters is where the business actually operates. LoanLeads.io filters on the business location the merchant provides, and you should confirm the operating address on the first call.

When is the best time to reach Delaware beach businesses?

Late winter and early spring are usually best. Rehoboth, Lewes, Dewey and Bethany businesses spend on staff, inventory and repairs before the summer season, which runs roughly Memorial Day to Labor Day. Some also look for capital in the fall to bridge the slower winter months.

Which Delaware industries fit a merchant cash advance?

Restaurants and lodging, retail stores, construction and trade contractors, healthcare practices, auto repair shops and poultry-related service businesses are common fits. They have regular deposits and recurring needs for inventory, equipment or payroll. You can include or exclude industries on your LoanLeads.io campaign.

What time zone should I use for Delaware merchants?

Delaware is on Eastern Time. Federal rules limit telephone solicitations to 8 a.m. through 9 p.m. in the recipient's local time. Remember that a Delaware-formed company may operate in another time zone, so set your dialer by the business's operating location, not its state of incorporation.
