Does Kansas regulate merchant cash advances?

Yes, Kansas requires cost disclosures on many merchant cash advances. The Kansas Commercial Financing Disclosure Act, passed as Senate Bill 345 in 2024, took effect July 1, 2024. According to law-firm summaries of the act, it covers commercial loans, accounts receivable purchase transactions and commercial open-end credit used for business purposes, in amounts of $500,000 or less. Accounts receivable purchases include factoring and merchant cash advances, where the funder buys a share of a business's future receivables instead of lending money.

Providers must give the merchant written disclosures at or before closing. The core items reported in legal summaries are:

DisclosureWhat it tells the merchant
Total funds furnishedThe purchase price or amount provided
Total disbursed, if differentWhat actually reaches the merchant after fees or payoffs
Total amount owedThe full amount the merchant will remit
Payment manner, frequency and amountHow remittances work, including estimates when payments vary

The act exempts depository institutions and their affiliates, Farm Credit lenders, Kansas-licensed money transmitters and providers that do no more than five commercial financing transactions in Kansas in a 12-month period. Unlike Missouri's law, it does not include a broker registration requirement. The Kansas Attorney General enforces it, and summaries note it does not create a private right of action.

What does this change for someone buying Kansas leads? Mostly the sales conversation. Kansas merchants who have shopped around may already have seen a disclosure from another funder, and they will compare totals, not just factor rates. Reps who quote a buy rate and a holdback without explaining the total remittance will lose deals to reps who walk through the numbers. ISOs should also confirm who on each deal is responsible for delivering the disclosure, the funder or the broker, and how the file proves it was delivered before signing.

This is general information as of 2026, not legal advice. Confirm current requirements, including any amendments, with counsel before you fund Kansas merchants.

Kansas small businesses by the numbers

Kansas has 273,419 small businesses that employ 599,134 people, or 48.9 percent of private-sector employees, according to the SBA Office of Advocacy's 2025 Small Business Profile (2022 Census data). Few states depend more on small firms for jobs. Small businesses make up 99.1 percent of all Kansas firms.

The business count is growing. Between March 2023 and March 2024, 11,181 Kansas establishments opened and 9,865 closed, a net increase of 1,316. Small businesses gained a net 10,601 jobs in that period.

Where those jobs sit matters for lead targeting:

  • Health care and social assistance: 99,333 small business employees
  • Accommodation and food services: 70,793, which is 60.4 percent of the sector
  • Manufacturing: 57,373
  • Construction: 54,791, with small firms holding 77.7 percent of construction jobs
  • Retail trade: 53,802

Bank lending to the smallest firms is modest in dollar terms. Reporting banks issued $633.6 million in 2023 loans to Kansas businesses with revenue of $1 million or less. Many of those owners, along with those who need money faster than a bank can approve it, are the audience for a merchant cash advance.

Where Kansas MCA demand comes from

Kansas MCA demand clusters in three economies: aviation manufacturing around Wichita, energy and agriculture in the west, and service businesses in the Kansas City suburbs.

Wichita and the aviation supply chain

The Kansas Department of Commerce calls Wichita the Air Capital of the World and says the state still builds roughly a third of the general aviation aircraft made in the US. Around the big airframe plants sits a long list of small machine shops, composite fabricators, tooling makers, coating shops and staffing firms. They work on purchase orders, wait on large customers to pay, and need cash when production rates change. For screening ideas, see manufacturing MCA leads.

Oil, gas and agriculture in western Kansas

The SBA counts 5,710 small businesses in mining, quarrying and oil and gas extraction in Kansas, a large number for a state this size. Well service companies, water haulers and equipment suppliers ride energy prices up and down. Farther west, the wheat harvest in early summer and the feedlot and meatpacking economy around Garden City, Dodge City and Liberal drive demand for trucking, repair shops and farm supply businesses. Revenue in these towns can swing hard from one year to the next.

Johnson County and the Kansas City suburbs

Overland Park, Olathe, Lenexa and Shawnee hold a dense mix of restaurants, salons, medical and dental practices, contractors and franchise owners. These merchants are pitched often by funders on both sides of the state line, so speed matters more here than anywhere else in Kansas.

Kansas City straddles two disclosure laws

The Kansas City metro sits in two states, and both have commercial financing disclosure laws with different details. Kansas's act took effect July 1, 2024 and has no broker registration. Missouri's Commercial Financing Disclosure Law, RSMo 427.300, requires provider disclosures and also requires brokers to register with the Missouri Division of Finance and post a $10,000 surety bond. Both cap coverage at transactions of $500,000 or less.

For a broker or funder working the whole metro, that means:

  • Tag each lead with the merchant's state, not just the metro, so your CRM triggers the right disclosure template.
  • If you broker deals for Missouri merchants, confirm your registration status before you call. Our Missouri MCA leads page covers the broker side.
  • Keep copies of every disclosure you or your funder delivers, signed or acknowledged, with the funding file.

Ask counsel how each state's law applies when a business is registered in one state and operates in the other.

Setting up a Kansas lead order

Build Kansas campaigns around region, because a Johnson County restaurant and a Hugoton oilfield service company need different offers. A practical setup:

  1. Johnson and Wyandotte counties: real-time exclusive leads, a revenue floor that fits your paper, and a fast first call.
  2. Wichita and Sedgwick County: real-time leads filtered to manufacturing, construction, food service and auto repair.
  3. Topeka, Lawrence, Manhattan and Salina: a mix of real-time and aged leads, since competition is lighter.
  4. Western Kansas: aged leads and live transfers, with industry filters for oil and gas services, trucking, ag supply and repair.

Mind the clock. Greeley, Hamilton, Sherman and Wallace counties on the Colorado border use Mountain time; the rest of Kansas is Central. The federal TCPA calling window for telephone solicitations runs 8 a.m. to 9 p.m. in the merchant's local time. Every LoanLeads.io lead includes TCPA consent captured at submission, and every affiliate is vetted before sending traffic.

Before the first call, have your Kansas disclosure ready. A rep who can explain total funds, total remittance and payment terms clearly will build more trust with Kansas owners, who are now used to seeing those numbers in writing. Start with a test order and scale the region that funds.

FAQ

Questions buyers ask

Does the Kansas disclosure law apply to merchant cash advances?

According to legal summaries, yes. The Kansas Commercial Financing Disclosure Act covers accounts receivable purchase transactions, which include merchant cash advances, along with commercial loans and open-end credit, for deals of $500,000 or less. It took effect July 1, 2024. Exemptions apply, so confirm with counsel how it applies to your deals.

Do MCA brokers have to register in Kansas?

The Kansas act, as summarized by law firms, does not include a broker registration requirement, unlike Connecticut's and Missouri's laws. It focuses on disclosures by providers. That could change through amendments, so confirm current Kansas requirements with counsel before brokering deals there.

Who enforces the Kansas Commercial Financing Disclosure Act?

The Kansas Attorney General enforces the act. Legal summaries note the law does not give merchants a private right of action based on compliance or non-compliance. Providers that do no more than five commercial financing transactions in Kansas in a 12-month period are exempt, along with banks and certain other institutions.

Which Kansas industries need MCA funding?

Aviation suppliers and machine shops around Wichita, oil and gas service companies, trucking and ag businesses in western Kansas, and restaurants, contractors, salons and medical practices in the Kansas City suburbs. The SBA's 2025 profile shows health care, food service, manufacturing and construction as the largest small business employers.

What time zone is Kansas in?

Most of Kansas is on Central time. Greeley, Hamilton, Sherman and Wallace counties along the Colorado border use Mountain time. Set your dialer by ZIP code so telephone solicitations fall inside the federal 8 a.m. to 9 p.m. window in each merchant's local time.

Can I buy Kansas City leads from both Kansas and Missouri?

Yes. You can set geography filters by state, county or metro. If you buy the whole Kansas City metro, tag each lead with the merchant's state, because Kansas and Missouri have different disclosure laws and Missouri requires broker registration and a surety bond.

Are aged leads useful in Kansas?

They can be, especially outside Johnson County and Wichita, where fewer funders compete for each merchant. Aged leads are older inquiries sold at a lower price per record. Work them with a steady cadence of calls, texts and emails, and track funded deals against cost before scaling.
